End-User License Agreement and Terms of Service

Virginia Mattress LLC (“Virginia Mattress,” “we,” “us,” or “our”) provides mattresses, bedding products, furniture, and related products and services through its website and other authorized sales channels.

Virginia Mattress LLC is an independent business and is not affiliated with, sponsored by, or endorsed by Intuit Inc. or QuickBooks.

You must be legally capable of entering into a binding agreement to use the Services and make purchases through our website.

If you use the Services on behalf of a business or organization, you represent that you have authority to bind that organization to this Agreement.

You agree to use the Services only for lawful purposes.

You may not:

• Use the Services for fraudulent or unlawful activities.

Payments may be processed through third-party payment services, including QuickBooks Payments and other payment providers that Virginia Mattress may make available.

When you submit payment information, you authorize the applicable payment processor to process the transaction according to its applicable terms and policies.

Virginia Mattress does not request that customers provide complete payment-card information through email, text messages, or other unsecured communications.

Payment processing may involve the transmission of transaction information to the applicable payment processor for authorization, processing, fraud prevention, settlement, and related purposes.

Certain Services may use an integration with QuickBooks or QuickBooks Payments.

If you authorize a connection between a third-party application or service and QuickBooks, the connection may allow information to be exchanged as permitted by the authorization and applicable API permissions.

You may revoke an authorized connection according to the controls made available by the applicable service.

Virginia Mattress is responsible for its own Services and customer support. Intuit/QuickBooks is a separate company and is responsible for its own products and services under its applicable terms.

All content on the Services, including text, graphics, logos, photographs, product descriptions, designs, software, trademarks, and other materials, is owned by or licensed to Virginia Mattress LLC unless otherwise indicated.

You may not reproduce, distribute, modify, sell, publish, or commercially exploit our content without our prior written permission, except where permitted by law.

The Services may contain links to or integrations with third-party websites, applications, payment processors, hosting providers, analytics providers, or other services.

Third-party services are governed by their own terms and privacy policies. Virginia Mattress LLC is not responsible for the independent policies, security, availability, or practices of third-party services.

We may suspend or terminate access to the Services when reasonably necessary, including for violations of this Agreement, fraudulent activity, abuse of the Services, security concerns, or legal requirements.

Termination does not eliminate obligations that by their nature should survive termination.

We may update this Agreement from time to time.

When we make material changes, we may update the Effective Date and provide notice through the website or other reasonable means.

Your continued use of the Services after an updated Agreement becomes effective constitutes acceptance of the updated Agreement to the extent permitted by law.

This Agreement will be governed by applicable laws of the Commonwealth of Virginia and applicable federal law, without regard to conflict-of-law principles, except where applicable law requires otherwise.
